CHIPS – TERMS & CONDITIONS
1. Introduction
Welcome to Chips (“we”, “our”, “us”). These Terms & Conditions govern your use of our website, mobile application, and services (collectively, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
2. Eligibility

You must be at least 18 years old or under supervision of a parent/guardian.

You confirm that all information provided is accurate and complete.
3. Account Registration

You are responsible for maintaining your account confidentiality.

You are responsible for all activities under your account.

We reserve the right to suspend or terminate accounts at our discretion.
4. Orders & Acceptance

Placing an order does not guarantee acceptance.

We reserve the right to:

Cancel any order before dispatch

Refuse or limit quantities

Reject orders due to pricing errors, stock issues, or suspected fraud
- Cancellation or correction of the order shall be the sole remedy in such cases.

Order confirmation messages do not guarantee acceptance.
- We may offer pre-order products. We reserve the right to delay or cancel pre-orders and issue a refund without additional liability.
5. Pricing & Errors

All prices are in Kuwaiti Dinar (KWD).

Prices may change without notice.

In case of pricing errors:

We may cancel the order, or
-
Contact you to confirm the correct price
- Cancellation or correction of the order shall be the sole remedy in such cases.
We are not obligated to honor incorrect pricing.
6. Payment Terms

Payment must be completed before order processing (except COD if available).

Payment authorization, fraud checks, and transaction approvals are the responsibility of the payment provider and issuing bank.
- We reserve the right to cancel or refuse any transaction suspected of fraud or unauthorized activity.
7. BNPL / Third-Party Services

Services such as Buy Now Pay Later (BNPL) or bank installment plans are provided by third parties.

Your agreement is with the provider, not Chips.

We are not responsible for approvals, fees, delays, or disputes.
8. Delivery & Risk

Delivery timelines are estimates and not guaranteed.

Risk transfers to the customer upon:

Delivery, or
-
First delivery attempt
-
Failed delivery due to incorrect details or unavailability may result in additional charges.
- Ownership of products remains with Chips until full payment has been successfully received, and the product has been delivered.
9. Returns & Refunds Policy
Return Period

Returns are accepted within 14 days from delivery date.
Conditions
- Items must be unopened, unused, and in original condition.

Must include original packaging, accessories, and invoice.
Non-Returnable Items
-
Opened or activated electronics and accessories (phones, tablets, etc.)

Products that have been activated, registered, or linked to an account (Apple ID, Google account, etc.)

Items with removed seals

Used, damaged, or scratched items

Software, digital products
Defective Items

Must be reported within 48 hours of delivery

Processed via original payment method

Processing time: 3–7 working days (excluding bank processing time, which may take up to 14 working days.)

Cancellation

Abuse
We reserve the right to reject returns or block accounts in case of misuse.
10. Warranty Policy

- Warranty is limited to repair or replacement only, and no other compensation shall be provided.
DOA (Dead on Arrival)

Data Responsibility

Customer must back up all data

We are not responsible for data loss
11. Product Information & Availability

We aim for accuracy but errors may occur.

Product images are for illustration only.

Availability is not guaranteed.
12. Promotions & Discounts

Promotions are subject to specific terms.

We may modify or cancel promotions at any time.

Orders abusing promotions may be canceled.
- Promotions and coupons may be limited to one-time use and cannot be exchanged for cash.
13. User Conduct
You agree not to:

Use the Platform for illegal or fraudulent purposes

Abuse or misuse services

Attempt to hack or disrupt the system
We reserve the right to suspend or block violators.
14. Limitation of Liability
To the maximum extent permitted by law:

We are not liable for indirect or consequential damages

We are not liable for loss of profit, data, or business
Our total liability shall not exceed the order value.
15. Indemnity
You agree to indemnify and hold Chips harmless from any claims, damages, or losses resulting from your misuse of the Platform.
16. Intellectual Property
All content on the Platform is owned by Chips or licensed to us.
You may not use or reproduce it without permission.
17. Termination
We may suspend or terminate access at any time without prior notice if Terms are violated.
18. Governing Law
These Terms are governed by the laws of the State of Kuwait.
19. Dispute Resolution
Any dispute shall first be resolved amicably.
If unresolved, disputes shall be subject to the competent courts of Kuwait.
20. Changes to Terms
We may update these Terms at any time. Continued use means acceptance of updates.
21. Disclaimer
The Platform and all services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.
